LICENSURE LAWS AND RULES A geologist licensing law was passed in Utah on March 6, 2002. The law (Title 58, Chapter 76), the Utah Geologist Practice Act, requires that geologists practicing geology before the public be licensed by January 1, 2003. To achieve this, an expedited process was implemented by the Utah Division of Occupational and Professional Licensing (DOPL), the group that administers the program. A licensing board was appointed by the governor in July 2002. The Professional Geologist Licensing Board finalized rules (R156-76) to clarify the new law. Following a 30-day public comment period, the rules became effective on September 3, 2002. The Utah Geologist Practice Act refers to the Division of Occupational and Professional Licensing Practice Act, (Title 58, Chapter 1). This Act is informally known as the "Umbrella Act," which includes the elements of the licensure program that are common to other licensed professions, such as disciplinary actions. In addition, the Umbrella Act's complementary rules, R156-1, General Rules of the Divison of Occupational and Professional Licensing, apply to the geologist licensing program. The license application became available on the Utah Division of Occupational and Professional Licensing (DOPL) website in early September 2002. DOPL is currently reviewing and awarding licenses to qualified geologists. LOBBYING UCPG established a relationship with professional lobbyists to assist us in the process of application for licensure as a profession and to submit legislation that benefits the profession of geology, as well as public health, safety, welfare, and the environment. Our lobbyists are Mr. Frank Pignanelli and Mr. Doug Foxley of Jones Waldo Holbrook & McDonough. Both men are attorneys and are well equipped to help us through the political process. They have given UCPG advice and assistance to organize the UCPG as a trade organization, and have provided input to our presentations with the Occupational and Professional Licensure Review Committee prior to the passage of the licensure law.
